Assault: causing V to apprehend immediate unlawful personal violence (Fagan v MPC [1969]). Battery: the actual application of unlawful force (Collins v Wilcock [1984]). Mens rea: intention or Cunningham recklessness as to causing V to apprehend force (assault) or applying force (battery). Summary offence under s.39 Criminal Justice Act 1988.
