Judgment and oi'der reversed and new trial ordered, with costs to appellant to abide event, on the ground that the verdict is against the weight of evidence as to the defendant’s negligence and as to the plaintiff’s freedom from contributory negligence. (Ingraham and Clarke, JJ., dissenting.)
