In a coram nobis proceeding, defendant appeals from an order of the County Court, Queens County, dated December 13, 1961, which denied, without a hearing, his application to vacate a judgment of said court, rendered December 2-7, 1957 after a jury trial, convicting him of murder in the first degree, and imposing sentence of death; the sentence, after the affirmance of the judgment (People v. Wynn, 4 N Y 2d 967), having been commuted, by executive clemency, to life imprisonment. Order affirmed. No opinion. Beldock, P. J., Ughetta, Kleinfeld, Christ and Hill, JJ., concur.
