In the Matter of Spring-Crosby-Lafayette Corp., Appellant. Philip Berman, Doing Business as Leader Lamp Mfg. Co., Respondent. [MAJORITY] Order unanimously reversed and the proceedings dismissed. The emergency rent in this case was above the amount fixed by the court as a reasonable rent. There was no authority in this proceeding under section 4 of chapter 3 of the Laws of 1945, as amended, to fix the rent in an amount which was below the emergency rent. Settle order on notice.
