Order reversed, with ten dollars costs and disbursements, and motion granted, -with ten dollars costs, striking out the first affirmative defense as insufficient and striking out from paragraph fourth of the answer all matter following the words: “ Plaintiffs complaint,’,’ with leave to the defendant to serve an amended answer within twenty days from service of order, if he be so advised, upon payment of said costs.
