In an action against defendant union to recover damages for assault and battery, order denying the union's motion to dismiss the first cause of action against it alleged in the amended complaint, insofar as appealed from, affirmed, with $10 costs and disbursements,, with leave to plaintiff to serve a second amended complaint as to the second cause of action within ten days from the entry of the order hereon.
