Appeal from the general term of the Supreme Court, in the third district, where a judgment of the County Court of Columbia county, in favor of the plaintiff, had been affirmed.

This case presented precisely the same question as Frees v. Ford, and was argued with it. The only difference was, that the damages claimed were $100.
Judgment reversed.
