Appeal from a judgment entered on the 11th day of- May, 1910, upon the verdict of a jury, and also from an order entered on the 23d day of May, 1910, denying a motion for a new trial. Judgment and order affirmed, with costs.

(dissenting): I dissent on the exception to the charge with - respect to the inference to be drawn by the jury on account of the failure of the defendant to produce or issue a commission to take the testimony of Russ, her former attorney. -.
