The result may be correct, but it cannot be determined from the Court of Appeal opinion; the trial judge was in egregious error in referring to the Commissioner’s report as not being “manifestly erroneous.” The Court of Appeal misstated the law in saying there is a duty on the buyer to inspect before purchase.
