Order reversed, with ten dollars costs and disbursements, and motion granted, with ten dollars costs, on the ground that the complaint does not state the facts upon which the liability is predicated, but states merely conclusions of law, with leave to plaintiff to serve an amended complaint within ten days on payment of said costs.
