[1] A careful review of the record in this appeal reveals that Hershfield J. made no factual or legal errors and properly evaluated all relevant evidence and considerations, when on September 8, 2004 he ordered that the appeal be dismissed with costs.
[2] There is no basis upon which this Court should intervene. Accordingly, the appeal should be dismissed with costs.
