[1] After reading the submissions found in the "Defendants' Motion Record" the motion for an order setting aside the 2000-04-03 order which granted default judgment on the Plaintiffs' 1998-12-21 Statement of Claim is denied with costs in the sum of $1,500 and which costs are assessed against Ian Brown and Marcus Leech. The costs are to be paid forthwith. [2] There is no merit for the present application. The present application should never have been brought.
