Phinn, an Immigration Officer, wherein the Immigration Officer decided not to exempt the applicant from the requirements of subsection 9(1) of the Immigration Act, R.S.C. 1985, c. I-2 (the Act). [2] Neither the applicant nor his representative was present at the hearing before me. I have therefore reviewed all the evidence and read the parties' written representations.
