[1] Although the issue of agency drivers went unaddressed in the decision of the Labour Board both parties understood from the decision that these drivers were clearly excluded from the bargaining unit.
[2] In our view, having regard to the very scant evidence placed by the applicant before the Board on this point, it cannot be said that the decision excluding the agency drivers from the bargaining unit is irrational or patently unreasonable.
[3] The application for judicial review will accordingly be dismissed, with costs in favour of the respondent/union.
