Éric Lafrenière, the respondent's counsel, filed his bill of costs on September 8, 2004 and asked that it be assessed without a personal appearance by the parties. The Correctional Service of Canada had not been given the status of an intervener in the proceeding. [2] A schedule for the filing of submissions was drawn up and given to the parties on September 22, 2004. To date, no submissions have been filed. In view of the foregoing, I am prepared to assess the costs in the respondent's favour. [3] The fees claimed and the disbursements for photocopying and for bailiff's fees are awarded as submitted. [4] The respondent's costs are assessed and allowed in the amount of $1,585.46.
