[1] In a decision released this day in IMM-1070-00 the Court set aside the decision of the Refugee Division of the Immigration and Refugee Board denying the applicant his claim to refugee status. In my view, the setting aside of that decision materially impacts the decision made by the Post-Determination Claims Officer (PCDO). [2] As a result, this judicial review application is allowed and the decision of the PCDO is quashed. In the circumstances, there is no necessity for a redetermination. No certified question arises.
