[2] On July 27, 2007, counsel for the respondent filed his memorandum of costs and asked that it be assessed without appearance by the parties. On June 6, 2008, we sent letters to the parties with a schedule for filing their written submissions. As no written submissions were received, I am now prepared to assess the memorandum of costs in accordance with the documentation in the record. [3] I awarded $1, 699.20 to be assessed for fees. The respondent is claiming for item 5 – preparation and filing of a contested motion, including the documents and responses relating thereto (7 units), for item 6 – appearance on a motion, per hour (3 units x 1.72 hours x $120) and for article 26 – assessment of costs (6 units). I awarded the fees as claimed with the exception of the assessment because it is not contested. [4] The disbursements of $25 seem reasonable to me in the circumstances of the matter and they will be awarded. [5] The memorandum of costs …
