[1] On February 23, 2011, this Court dismissed with costs the appellant’s appeal from a decision of the Tax Court of Canada which affirmed the Minister of National Revenue’s Income Tax Assessments of the appellant’s 2005 and 2006 taxation years. [2] By his motion, the appellant is, in effect, asking the Court to relieve him of the obligation to pay the costs payable to the respondent pursuant to our judgment of February 23, 2011. As the delay to appeal our judgment has long expired, there is no basis upon which the appellant’s motion could be granted. [3] For these reasons, the appellant’s motion shall be dismissed but, in the circumstances, without costs. “M. Nadon” J.A.
