The appellant appeals a decision of the First-tier Tribunal (Judge of the First-tier Tribunal Andrew) sent to the parties on 10 August 2023 dismissing her appeal against the respondent's refusal of her permanent residence application.
The appellant did not attend the hearing at Field House. Observing rule 38 of the Tribunal Procedure (Upper Tribunal) Rules 2008 I decided it was in the interests of justice to proceed with the hearing in the absence of the appellant. I was satisfied that a notice of hearing had been sent to the last known address of the appellant.
Additionally, Mr Lindsay confirmed on behalf of the respondent that the decision of the Judge was properly to be set aside on the grounds of procedural unfairness.
The hearing before the First-tier Tribunal proceeded on the papers. The Judge detailed, at [7]-[8] of her decision:
"7. The appellant has provided no evidence to show she was resident in the United Kingdom before the Specified Date. I have no Appellant's Bundle before me, merely the Grounds of Appeal.
