This is an appeal from the decision of First-tier Tribunal Judge Mackenzie at Harmondsworth dismissing the appellant's appeal from the decision of the Secretary of State for the Home Department refusing her indefinite leave to remain as the spouse of a settled person.
Ms Anagap was married in the Philippines on 27 February 2012 to Mr Clifford White. Mr White is a British citizen and is also her sponsor. On 23 May 2012 Mrs White arrived in the UK with entry clearance valid until 23 August 2014 and has since then lived with her husband in Bourne End, Buckinghamshire.
On 30 July 2014 she applied for indefinite leave to remain. That application was refused on 23 June 2015 as the Secretary of State was not satisfied that Mrs White met the requirements of paragraph 287 of the Immigration Rules, in particular a requirement that she and her husband would be able to maintain themselves adequately without recourse to public funds.
Judge Mackenzie was asked to, and did, determine the appeal on the papers. She found that Mrs White had not satisfied her that she met the requirements of paragraph 287 of the Rules and for that reason the learned Judge upheld the Secretary of State's decision on paragraph 287.
