            This appeal was resumed in the Upper Tribunal following an error of law being found in a First-tier Tribunal decision which was set aside on 28 th July 2023.

            On 3 rd February 2021 his representatives wrote with further mitigation in response to the investigation letter asserting that 3 years delay was of great significance.
