In 1825, the majority of a meeting of heritors approved of a plan for enlarging the church, and obtained a decree of the presbytery approving of the same, and decerning against the heritors for their respective proportions of the estimated expense of executing it.
The opposing heritors suspended a charge on this decree; and the Lord Ordinary pronounced the following interlocutor, accompanied with an explanatory note. ‘Finds it admitted by the charger, that the church of Methven is standing in good condition; and, therefore, sustains the reasons of suspension, and suspends the letters simpliciter .’
The charger reclaimed ; and the Court , in order to get a solemn judgment upon the general question, ordered cases for the opinion of the whole Judges.
