             The appellant in the appeal before me is the Secretary of State for the Home Department ("SSHD") and the respondent to this appeal is Mr Muhammad Khalid Mahmood. However, for ease of reference, in the course of this decision I adopt the parties' status as it was before the FtT. I refer to Mr Mahmood as the appellant, and the Secretary of State as the respondent.
             Permission to appeal to the Upper Tribunal was granted by First-tier Tribunal Judge Boyes on 22 June 2022.
             On 31 January 2023 the Court of Appeal handed down its judgement in Celik v SSHD [2023] EWCA Civ 921 . On 23 October 2023, Upper Tribunal Judge Blundell issued Directions. He said:
"2. The Court of Appeal's judgment was handed down on 31 July 2023 and the papers have been placed before me today to give instructions for the listing of the appeal. As presently advised, it is my provisional view that Judge Juss's decision cannot survive the decision of the Court of Appeal. Provisionally, it seems likely that the outcome of the appeal will be that the Secretary of State succeeds in establishing an error of law on the part of the judge and that the decision on the appeal can be remade in the Upper Tribunal in accordance with the decision of the Court of Appeal.
The parties must now review their positions in light of the Court of Appeal's decision.
