             The appellant in the appeal before the Upper Tribunal is the Secretary of State for the Home Department ("SSHD") and the respondent to this appeal is Mr Sharjeel Khan. He claimed he was born in Nowshera, Pakistan and provided a birth certificate as evidence of his name and place of birth. The birth certificate states the appellant's parents are Noor Ul Wahab and Gul Tamama, both of whom are described as citizens of Pakistan. The appellant's grandfather, Abdul Jalil is also said to be a national of Pakistan.
             The issues are:
a.       Whether it was open to the Secretary of State to conclude that the appellant's naturalisation was obtained by means of fraud, false representation, or concealment of a material fact, applying public law principles.
b.       Whether the decision is unlawful under s6 of the Human Rights Act 1998.
