              The appellant is a citizen of Brazil born in 1991. The appellant does not associate with the gender assigned to her at birth. She identifies as a woman. She appeals against the decision of First-tier Tribunal Judge Kelly dated 22 May 2023 dismissing her protection claim and allowing her appeal on human rights grounds.

              The appellant appealed on the following five grounds. The judge erred in:

(i)             conflating acts of persecution with the motivation of the persecutor;
