[1] The pursuer raised an action of damages against the defender in respect of personal injuries sustained on 2 December 2008. Liability was admitted subject to issues of causation and quantum of damages.
[2] The pursuer was represented by Mr Murphy, advocate. The defender was represented by Mr Cowan, solicitor advocate.
[3] Both representatives in this case lodged written submissions and I am grateful to them for these. I have had full regard to their terms.
[4] The circumstances of the incident giving rise to the claim for damages can be summarised as follows: the pursuer was driving a vehicle which was stationary at a give way sign at a junction, when it was suddenly and without warning struck from behind by a motor vehicle being driven by the defender.
The pursuer asserted that as a result of the accident he had suffered the following physical injuries: a soft tissue injury to the neck, and pain and stiffness to his neck, left shoulder and lower back, the effects of which had subsided but were continuing.
