The appellant appeals, with permission, against the decision of the First-tier Tribunal dismissing his appeal against the respondent's decision of 19 September 2016 refusing his protection and human rights claim further to a decision to deport him pursuant to section 32(5) of the UK Borders Act 2007 and a decision to cease his refugee status .

The respondent sought permission to appeal to the Upper Tribunal in regard to the judge's decision on Article 3 and 8. Permission to appeal was initially refused but was subsequently granted in the Upper Tribunal on 11 May 2017.
The appeal came before me on 30 June 2017. I heard submissions on the error of law.
Ms Gasparro, in response, reiterated the submissions previously made, submitting that the appellant's case could be distinguished from the reliance in N on D v United Kingdom (1997) 24 EHRR 425 cases.
