             The appellant is a citizen of Uganda born on 17 September 1973. She appeals against the decision of First-tier Tribunal Judge Sangha dated 20 September 2023 dismissing her appeal against the refusal of leave to remain under the EU Settlement Scheme ('EUSS').
             The appeal came before me on 19 January 2024 and I found there was an error of law in the decision of the First-tier Tribunal ('FTT') for the reasons given in my decision dated 23 January 2023 (see Annex A). The FTT decision was set aside and the appeal was adjourned for remaking.
             In response to directions, the respondent served further evidence in the form of an email from the Ugandan High Commission dated 1 March 2024 (see Annex B) which confirmed the marriage was valid and the appellant was legally married to the EEA sponsor on 30 October 2015.
             As a result, the appellant made written submission dated 12 March 2024 in which she stated:
" The respondent has indicated that they are no longer defending the case. I am very grateful for this. In the light of the above it is the appellant's submission that the honourable judge rule that the appellant has made out her case and that the Respondent has conceded the case. The defence is therefore dismissed, and the appeal upheld.
