Lord Meadowbank .—She has made her election to bring a consistorial action, and has of course shut herself out of the benefit of an ordinary action of damages.
Lord Justice-Clerk .—Whether or not the statute gives us a discretionary power to grant trial by Jury in consistorial cases, I am satisfied it would be inexpedient to do so in this instance.
