              This is an appeal by the Secretary of State against the decision of the First-tier Tribunal allowing the appeal of the respondent, herein after "the claimant", against the decision of the Secretary of State on 2 June 2021 refusing him a residence card as the husband of a Greek national present in the United Kingdom and exercising treaty rights.
              Permission to appeal was granted by the Upper Tribunal on 12 February 2025.
              This appeal has a long history and I am particularly grateful to the claimant's "Rule 24 response" for a brief summary.
              This shows that the claimant entered the United Kingdom unlawfully in 2017 or 2018. On 19 November 2018 he was convicted of offences involving the production of cannabis and was sentenced to nine months' imprisonment. He was deported on 20 December 2018. However, in breach of a deportation order he re-entered the United Kingdom in early 2019.
              On 24 December 2020 he applied for a residence card as the spouse of a Greek national exercising treaty rights in the United Kingdom. He was not then married but he married on 3 April 2021. The application was refused in a decision dated 2 June 2021 and the claimant appealed. The appeal was allowed by the First-tier Tribunal on 26 February 2022 and the Secretary of State appealed to the Upper Tribunal.
