[1] With respect to the questions in issue in the Novopharm appeal and the "source of supply" questions in the Apotex appeal, we are unable to conclude that the questions are relevant. The statements of claim contain factual allegations relating only to nizatidine made by the Shasun process, but the questions do not appear to be so limited.
[2] With respect to the remaining questions in the Apotex appeal, we are not persuaded that there is any basis for the intervention of this Court.
[3] Accordingly we will allow the Novopharm appeal and the Apotex appeal with respect to the "source of supply" questions.
