Motion on behalf of Plaintiffs for:
1. An Order striking out the Defence filed by the Defendant in this matter;
2. An Order for the Defendant to pay costs incurred by the Plaintiffs as a result of the inaccurate or deficient affidavit of documents filed by the Defendant on a solicitor-client basis, in the amount of $10,454.39;
3. Such further relief as this Honourable Court may seem just.
(Rules 3, 24, 222, 224, 226 and 227 of the Federal Court Rules, 1998)
REASONS FOR ORDER AND ORDER
[1] I am not satisfied that the dispute between the parties concerning the sufficiency of the Defendant's affidavit of documents calls for the drastic remedy of striking out the Defendant's statement of defence. In light of the position taken by counsel for the Defendant with regard to said affidavit, the Plaintiffs shall have the right to pursue the discovery of the Defendant, at the latter's costs, in order to probe the sufficiency of the Defendant's affidavit of documents dated May 7, 2001 and to ask proper questions further to the undertakings to be fulfilled further to a separate order of this Court dated October 29, 2001.
[2] Costs of this motion in the amount of $1,000 go to the Plaintiffs.
