(2002 FCT 788) allowing with costs the motion of the respondent and striking out in its entirety without leave to amend the statement of claim filed by the appellant. [2] The learned judge found that the statement of claim discloses no reasonable cause of action and has not the slightest chance of success. He found, in addition, that the claim is prejudicial as well as futile and not susceptible of leading to a legal remedy with respect to the facts alleged. He went on to state that "The Crown cannot respond to the claim as pleaded nor could the Court regulate the conduct of such action". The appellant's written and oral submissions to this Court fail to identify any reviewable error that would have been committed by the motions judge. [4] The appeal should be dismissed with costs here and below.
