[1] In light of the Supreme Court judgment in Free World Trust v. Électro Santé Inc., [2000] 2 S.C.R. 1024, we cannot find any error in the trial judgment that might justify our intervention. Just as in this decision by the highest court (see in particular para. 74 of the decision), the essential aspects of the respondent's tool in the case at bar, both in construction and operation, differ from that claimed in the patent. The evidence enabled the trial judge to conclude as he did.
[2] The appeal will be dismissed with costs.
