ASSESSMENT OF COSTS – REASONS
MICHELLE LAMY, ASSESSMENT OFFICER
[1] On March 5, 2004, the Court allowed the appeals of the decisions by the Federal Court in the matters involving the Caisse populaire d’Amos (T-1422-00) and Caisse populaire Desjardins de Lebel-sur-Quévillon (T-1423-00) and awarded the appellant costs in both proceedings. At the request of the appellant, I sent the parties a schedule requesting that they submit their written submissions against the bill of costs filed for assessment on January 31, 2006. As there was no response, I am prepared to proceed.
[2] In light of the proceedings in the record and the criteria listed under subsection 400(3) of the Federal Courts Rules, it is my opinion that these claims are reasonable; the appellant moreover did not duplicate anything in either bill of costs. However, I have reduced the number of units requested under item 26 to two (2) in each matter because everything proceeded uncontested.
[3] In conclusion, certificates of assessment are issued as follows: $4,886.06 (T-1422-00), $5,043.69 (T-1423-00), 3,529.97 $ (A-627-02) and $3,067.19 (A-628-02). These reasons are filed in docket A-627-02 and copies placed in A-628-02, T-1422-00 and T‑1423-00.
