[2] On December 18, 2003, counsel for the respondent filed his bill of costs accompanied by a request for a decision without personal appearance of the parties. [3] On January 12, 2004, a timetable was prepared so that the applicant could file its submissions, which it has not done to date. In light of the foregoing, I am prepared to assess costs in favour of the respondent. [4] The requested fees are awarded, except with respect to the claim made under item 26. As the assessment of costs is not contested, 2 units are awarded under item 26. [5] The disbursements claimed ($138.54) arejustified and will be awarded as requested. [6] The costs of the respondent are therefore assessed and allowed in the amount of $1,343.04.
