On September 23, 2004, Mr. Yann Duguay filed the Plaintiff's bill of costs and asked that it be assessed without personal appearance of the parties. [2] Defendant, was given until October 28, 2004 to serve and file written representations in response to the bill of costs. To date none have been received. The assessment will proceed on the basis of the documentation on file. [3] Plaintiff's counsel fees are allowed as presented for items 1, 4, 6, 25 and 26. [4] Plaintiff's counsel is also requesting fees payable under tariff A which will be allowed. [5] The disbursements in the amount of $ 66.22 will be allowed because in my opinion they are reasonable and justified by Mr. Guy Vaillancourt's affidavit. [6] The plaintiff's costs are assessed in the amount of $ 2, 014.14 which represents $1,897.92 ($1650.00 + taxes) for counsel fees, $50.00 for fees under Tariff A and $66.22 for disbursements. [1] On July 21, 2004, the Honourable Johanne Gauthier allowed the Plaintiff's motion for default judgment, with costs. On September 23, 2004, Mr. Yann Duguay filed the Plaintiff's bill of costs and asked that it be assessed without personal appearance of the parties.
