At the request of the defendant, the assessment was based on the written submissions of the parties. [2] Having reviewed the submissions, we award fees in the amount of $1,518.33 ($1,320.00 plus GST/QST) for items 5 (7 units) and 26 (4 units) under Tariff B. In light of the defendant’s submissions, we maintain the number of units requested under item 5 because of the volume of work required to prepare the motion to strike out the action, including the reply documents. At the plaintiff’s suggestion, we allow 4 units for the assessment of costs, since this is a relatively simple proceeding. [3] However, all expenses incurred in the case are allowed in the amount of $366.76, being proven by affidavit and uncontested.
