The case originated in an application (no. 74420/01) against the Republic of Lithuania lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by a Lithuanian national, Mr Kęstas Ramanauskas (“the applicant”), on 17 August 2001.
The applicant, who was granted legal aid, was represented by Mr R. Girdziušas, a lawyer practising in Kaunas. The Lithuanian Government (“the Government”) were represented by their Agent, Ms E. Baltutytė.
The applicant alleged, in particular, that he had been the victim of entrapment and that he had been denied the opportunity to examine a key witness in criminal proceedings against him.
The application was allocated to the Second Section of the Court (Rule 52 § 1 of the Rules of Court). Danutė Jočienė, the judge elected in respect of Lithuania, withdrew from sitting in the case (Rule 28). The Government accordingly appointed Jean-Paul Costa, the judge elected in respect of France, to sit in her place (Article 27 § 2 of the Convention and Rule 29 § 1).
