This is my second judgment in this case. My first judgment in this matter was an ex-tempore judgment delivered on Friday, 20 th February 2026 ( [2026] IEHC 126 .) In that judgment, I struck out the plaintiff's proceedings as being moot, in circumstances where the first and third defendants had resigned from the Disciplinary Appeal Panel ("DAP") and the second defendant had effectively given an undertaking that she would no longer serve on any new DAP.
This judgment deals with two further issues in these proceedings:
(1)    first, Mr. Burke's application that I should address a specific argument which he made at the hearing on 20 th February and which he complains I did not address in my first judgment (i.e. his argument that I should send Mr. O'Longain's affidavits to the Director of Public Prosecutions, on the grounds that he, Mr. Burke, alleges that Mr. O'Longain has lied on affidavit and committed perjury); and
(2)    secondly, whether a contempt of court was committed by Mrs. Martina Burke and Ms. Ammi Burke at the hearing on Friday, 20 th February 2026.
Mr. Burke was released from prison that day, and instead of spending his time wisely preparing for this case, he decided that he would commit another contempt of court and trespass again upon the school property. As a result, he was again arrested and imprisoned within a few days.
