The jurisdiction of the Circuit Court and the District Court to grant an Isaac Wunder order
      One way or another, therefore, I agree that the development of the Isaac Wunder jurisdiction is a necessary and indispensable feature of the administration of justice so that these constitutionally derived powers must be deemed to be vested in both the Circuit Court and the District Court. I also agree with Collins J. that it would be desirable that the parameters of this jurisdiction were regulated by law. While it might be useful if this jurisdiction was regulated by statute law, it should, at a minimum, also be regulated by Rules of Court.
      What it does mean, however, is that the Oireachtas must nonetheless respect the demarcation between the full original jurisdiction conferred on the High Court by Article 34.3.1⁰ on the one hand, and the "local and limited" nature of the Circuit Court's Article 34.3.4⁰ jurisdiction on the other. This means in turn that the latter Court "may not be erected into a localised replica of the High Court": see JP Casey, "The Constitution and the Legal System" (1979) 14 Irish Jurist 14 at 18.
      As matters stand, it is clear from the provisions of the Third Schedule to the Courts (Supplemental Provisions) Act 1961, that jurisdiction is exercised locally, in that the Circuit Court can only hear cases against defendants residing in or carrying on business in or arising out of events happening in or immoveable property situate in, the Circuit in question. �But what is the status of these orders outside of the Circuit (or, in the case of the District Court, the relevant District) in which they are made?
  What the Circuit Court could not do, however, is to make an order in rem which takes effect outside of its jurisdiction. If, for example, the Circuit Court in Circuit A were to make a monetary award against X, it would not itself have jurisdiction to make a well-charging order against immoveable property situate in Circuit B in the event that this award remained undischarged. In those circumstances, it would be necessary to apply to the Circuit Court sitting in Circuit B for this relief.
