The case originated in an application (no. 35121/09 ) against Ukraine lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (�the Convention�) by a Ukrainian national, Mr Yuriy Mykhaylovych Koval (�the applicant�), on 15 June 2009.

The applicant was represented by Mr Y.V. Zinchenko, a lawyer practising in Mykolaiv. The Ukrainian Government (�the Government�) were represented by their Agent, most recently Mr I. Lishchyna.

(i) he had been ill-treated by the police in the course of his arrest on 16 November 2007 and that there had been no effective investigation in that regard, in breach of Article 3 of the Convention;
