NATIONAL COUNCIL FOR SPECIAL EDUCATION, MINISTER FOR EDUCATION AND SKILLS, SCHOOL TRANSPORT APPEALS BOARD
This is an application for an order of certiorari quashing the decision of the School Transport Appeals Board (the Appeals Board) of 20 July 2020 (the Decision), disallowing the applicants school transport appeal. Various declarations are also sought, including a declaration that the Appeals Board failed to give any or adequate reasons in its decision of 20 July 2020. For the reasons set out in this judgement, I conclude that the reasons given were indeed inadequate and I therefore remit the matter back to the Appeals Board for further consideration of the appeal.
By Order of the High Court of 21 September 2020, the applicants were granted leave to apply for judicial review of the Decision of the Appeals Board of 20 July 2020 and to seek declaratory relief in relation to the Special Educational Needs Scheme.
The reliefs sought at paragraph D of the Amended Statement of Grounds dated 16 September 2020 include:
1. An order of Certiorari quashing the decision of the third named Respondent of 20 July 2020, disallowing the Applicants school transport appeal.
