[1]������ The father has made an application under the Hague Convention for a return order in respect of the children. �Matters were originally listed for hearing last year but significant issues arose. �In October, McFarland J determined that the habitual residence of the children was the Republic of Ireland. �Issues then arose about rights of custody under Irish law.

[2]������ This aspect of the proceedings is focused on two issues to be determined by the court.

[3]������ The first is the determination of the age of the parties at the date of their marriage and the second is the validity of that marriage.
