Anonymity is granted because the facts of the appeal involve a protection claim. Unless and until a tribunal or court directs otherwise, the respondents are granted anonymity. No report of these proceedings shall directly or indirectly identify them. This direction applies both to the appellant and to the respondents. Failure to comply with this direction could lead to contempt of court proceedings.
The Secretary of State appeals with permission against the decision of the First-tier Tribunal Judge Drake (hereinafter referred to as the "FtTJ") who allowed their protection and human rights appeals in a decision promulgated on the 11 March 2022.
Permission to appeal was granted by FtTJ Austin on 20 April 2022.
Whilst this is the appeal brought on behalf of the Secretary of State, for sake of convenience I intend to refer to the parties as they were before the First-tier Tribunal.
The FtT did make an anonymity order and no grounds have been raised by the parties that the anonymity direction should be discharged. The order shall be continued in the terms as set out above.
