Deputy Bailiff and a jury, the appellant was convicted of offences of rape (Count 2) and gross indecency (Count 3) committed between 18th February, 1978, and 20th February, 1979, against his adopted daughter, B when she was aged 15 years. He was acquitted by the jury of an allegation of indecent assault upon his adopted daughter C between July 1977 and July 1979 when she was aged 16 or 17 (Count1).
The appellant seeks leave to appeal his convictions on the following two grounds, he did not pursue a third ground before us;
(i) That the evidence relating to his internet searches for material relating to incest and underage sexual images of children ought to have been excluded from the trial as unfair;
