A solicitor is acting for a lender in a residential remortgage of a registered property. The borrower's title shows a registered charge in favour of a previous lender (Bank A) which the new advance will redeem. The borrower assures the solicitor that Bank A's charge will be discharged on completion and the redemption statement has been obtained. Completion takes place and funds are sent to Bank A. Six weeks later, the solicitor attempts to register the new charge and discovers that Bank A's charge has not yet been formally discharged because Bank A's DS1 has not been received.
