The essay prompt
The right to a fair trial is said to include a right to be tried within a reasonable time. Is it fair to prosecute people for offences committed a very long time ago? Argue for a clear position and say why.
The stance
No, as a general rule. Where very long delay is not caused by the accused's own concealment, prosecuting decades-old offences corrodes the conditions a fair trial depends on - intact evidence, a defensible defendant, and a bounded state - so such prosecutions are usually not fair; the law should presume against them while keeping narrow exceptions for genuinely concealed or exceptionally grave crimes.
The case for
Delay destroys the evidentiary integrity a fair trial depends on.
Justice relies on reliable proof, but over decades witnesses die, documents are lost and memory both fades and is unconsciously rewritten. A trial in which the truth can no longer be reconstructed is a procedural shell, not a fair hearing. This is why English law allows proceedings to be stayed for delay: in Attorney General's Reference (No 1 of 1990) the Court of Appeal held a stay should follow where the defendant shows that, because of delay, he will suffer such serious prejudice that no fair trial can be held.
The case against
Modern forensics can make late prosecutions more accurate, not less.
DNA analysis and digital records can convict the genuinely guilty long after the event and can exonerate the wrongly suspected, which is precisely how many cold cases are now resolved. For the gravest crimes the imperative to convict a murderer may seem to outweigh evidential decay, suggesting some late prosecutions can still be fair.
