Climate change should be treated as a human rights issue, not merely as environmental regulation, because it satisfies the recognised criteria of a human right and threatens the preconditions of life and dignity; but the framing earns its force only when it is anchored in the present rights of identifiable, living claimants, since the extraterritorial and intergenerational versions of the argument remain legally fragile.
The case for
Climate change attacks the preconditions of every other right, which is the mark of a fundamental, not merely regulatory, concern.
Human rights protect what is foundational to a dignified life. Famine, lethal heat, flooding and the collapse of water and food systems extinguish the very conditions on which the rights to life, health and home depend. A right to life is hollow on an uninhabitable planet, so harm of this magnitude crosses the line from a policy failure that regulation manages to a rights violation that law must prevent. Regulation balances; rights protect a floor below which the state may not push people.
The case against
Courts lack the competence and legitimacy to set climate policy, which is irreducibly polycentric.
Emissions pathways trade off energy security, employment, fiscal limits and competing technologies in ways that resist judicial line-drawing. Converting these into rights claims invites unelected judges to make distributive choices that belong to legislatures, and risks substituting a court's view of an adequate target for democratic deliberation. Regulation, on this view, is not weaker than rights but more honest about who should decide.
